German DSA Part 2

§ Section 5 General information obligations
(1) Service providers must keep the following information, which must be easily recognisable and directly accessible, permanently available for business-related digital services that are generally offered for a fee:
1.
the name and address at which they are established, in the case of legal entities additionally the legal form, the authorised representative and, if information on the company's capital is provided, the share capital or nominal capital and, if not all contributions to be made in cash have been paid in, the total amount of outstanding contributions,
2.
Information that enables rapid electronic contact and direct communication with them, including the address for electronic mail,
3.
if the service is offered or provided as part of an activity requiring official authorisation, details of the competent supervisory authority,
4.
The commercial register or similar register in which they are entered and the corresponding register number,
5.
where the service is offered or provided in the exercise of a profession within the meaning of Article 1(d) of Council Directive 89/48/EEC of 21 December 1988 on a general system for the recognition of higher-education diplomas awarded on completion of professional education and training of at least three years' duration (OJ L 19, 24.1.1989, p. 16), or within the meaning of Article 1(d) of that Directive. 16), or within the meaning of Article 1(f) of Council Directive 92/51/EEC of 18 June 1992 on a second general system for the recognition of professional education and training to supplement Directive 89/48/EEC (OJ L 209, 24.7.1992, p. 25; L 17, 25.1.1995, p. 20), as last amended by Directive 2006/100/EC (OJ L 363, 20.12.2006, p. 141), information on
a)
the chamber to which the service providers belong,
b)
the legal professional title and the state in which the professional title was awarded
c)
the name of the professional regulations and an indication of how these regulations can be accessed,
6.
In cases where they have a VAT identification number pursuant to Section 27a (1) sentences 1, 2 or 3 of the German Value Added Tax Act (Umsatzsteuergesetz) or a business identification number pursuant to Section 139c (1) of the German Fiscal Code (Abgabenordnung), the details of this number,
7.
In the case of stock corporations, partnerships limited by shares and limited liability companies that are being wound up or liquidated, an indication of this number,
8.
In the case of providers of audiovisual media services, the following information
a)
the Member State in which they are established or deemed to be established, and
b)
the competent regulatory and supervisory authorities.
(2) Further information obligations under other legal provisions shall remain unaffected.

Sections 1, 2, 3, 4, 5, 6 and 23 implement Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (‘Directive on electronic commerce’) (OJ L 178, 17.7.2000, p. 1), as last amended by Regulation (EU) 2022/2065 (OJ L 277, 27.10.2022, p. 1; L 310, 1.12.2022, p. 17). Sections 1, 2, 3, 6, 9, 10 and 11 serve to implement Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive) (OJ L 95, 15.4.2010, p. 1). L 95, 15.4.2010, p. 1; L 263, 6.10.2010, p. 15), which was last amended by Directive (EU) 2018/1808 (OJ L 303, 28.11.2018, p. 69). § Section 8 serves to implement Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society (OJ L 167, 22.6.2001, p. 10; L 6, 10.1.2002, p. 71), which was last amended by Directive (EU) 2018/1808 (OJ L 307, 28.11.2018, p. 69). 71), as last amended by Directive (EU) 2019/790 (OJ L 130, 17.5.2019, p. 92), and Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on the enforcement of intellectual property rights (OJ L 157, 30.4.2004, p. 45; L 195, 2.6.2004, p. 16).
